When you use Nearby Delivery, we collect information necessary to fulfill your orders and improve our service:
- Phone number — collected at sign-up via Clerk for authentication and order notifications
- Email address — optionally collected after your first order for receipts and updates
- Delivery address — collected at checkout to verify our delivery zone and deliver your order
- Payment information — processed directly by Stripe; we never store card numbers
- Order history — retained to support your account and process refunds
2. How We Use Your Information
- To process and fulfill your orders
- To send order confirmations, status updates, and delivery notifications
- To verify your address is within our delivery zone
- To process refunds and resolve disputes
- To respond to customer support requests
- To improve our service and product selection
3. How We Share Your Information
We do not sell your personal information. We share data only with:
- Stripe — payment processing (governed by Stripe's Privacy Policy)
- Clerk — authentication (governed by Clerk's Privacy Policy)
- Resend — transactional email delivery
- Twilio — SMS notifications (only if you have no push subscription)
4. Your Rights (CCPA)
As a California resident, you have the right to:
- Know what personal information we collect about you
- Request deletion of your personal information
- Opt out of the sale of your personal information (we don't sell it)
- Non-discrimination for exercising your privacy rights

5. Data Retention
We retain your account information as long as your account is active or as needed to provide services. Order history is retained indefinitely for dispute resolution and tax purposes. If you delete your account, we anonymize your personal information within 30 days while retaining order records.
6. SMS Notifications
When you provide a phone number at sign-up, you consent to receive transactional SMS messages from Nearby Delivery. These messages are sent solely to notify you about your orders — for example: order confirmation, out-for-delivery alerts, and delivery confirmation. We do not send marketing or promotional messages via SMS.
Message frequency varies based on order activity (typically 2–4 messages per order). Message and data rates may apply depending on your carrier plan.
To opt out of SMS notifications, reply STOP to any message we send. You will receive a one-time confirmation and no further SMS will be sent. To opt back in, reply START. For help, reply HELP or contact us at hello@nearby.delivery.
Your phone number is shared with Twilio solely to transmit these transactional messages. It is never sold or shared with third parties for marketing purposes.
7. Push Notifications
If you subscribe to push notifications, we store your browser's push subscription endpoint. You can unsubscribe at any time from your account settings.
8. Cookies
We use session cookies for authentication (via Clerk) and no third-party tracking cookies. We use LogRocket for session replay and product diagnostics so we can reproduce issues and improve the service. LogRocket may process interaction data according to its privacy policy; we do not use third-party advertising cookies for analytics.
9. Security
Your data is transmitted over HTTPS and stored in Neon Postgres with access limited to our application. Payment data never passes through our servers — it goes directly to Stripe.
10. Changes to This Policy
We may update this policy as we add features. We'll notify you of material changes via email or in-app notice.
